1. Definitions
"Customer" means the person or legal entity identified in RamCity's Invoice.
"Products" means any products supplied to the Customer and described in RamCity's invoice.
"RamCity" means RamCity, a business registered in NSW, Australia. (ABN 87 436 655 205.)
"Contract" means any sales contract entered into by Customer and RamCity in respect of the Products and services supplied in which these Terms are deemed to be incorporated. ↑
2.0 Payment and Delivery
2.1 RamCity accepts payment using all major credit cards - including American Express, Diners Club, Mastercard, Visa Card, and Bankcard. We do not charge any additonal administration fees for the use of credit cards. We reserve the right to decline credit card payments (and/or request an alternative method of payment) at our discretion. Your credit card will not be debited until the day we ship your goods.
2.2 We also accept payment by bank transfer (EFT) into our Australian bank account, or by approved cheque, money order or draft (in Australian Dollars only). Note that your order will not be processed unless the bank transfer reference or cheque includes your RamCity order reference number and is cleared to our account. Note that a bank transfer or cheque order is not confirmed as accepted by us until payment has been received, and also that if the ordered item is an item that needs to be backordered we will not procure it until the payment has been received. If an item is not in stock in our Sydney or Auckland warehouse when payment is received, and proves unable to be further procured, we will provide a full prompt refund. Should you cancel your order, we will provide a full refund within 7 days from the date of cancellation.

2.3 If your goods fail to arrive within 28 days of dispatch, and you have notified us of late arrival within 7 days of receiving email notification that your order has shipped, you will have the option of either a full refund or a replacement shipment. ↑ 2.4 Where an incorrect address has been given to RamCity with the order, or the courier is unable to deliver due to repeated unavailability of anybody to sign for the delivery, we reserve the right to charge for any extra delivery costs incurred. 2.5 Title to all goods supplied by us will not pass to the customer until payment in full has been received. ↑ 2.6 RamCity will ship your products as soon as possible after your payment is processed in full. In most cases (where we have stock available), orders received by 1:00pm EST during weekdays will be shipped the same business day and orders received later in the day will be shipped the following business day. 2.7 If your order contains multiple items, and not all items are in stock, RamCity will hold your order until all items are in stock before delivering, unless you advise us to do otherwise. In any case we will always advise you of the partial availability and give you the option to split the order for an additional delivery charge of AUD$10 for Australian and New Zealand customers, or AUD$29 for all other International customers.. 2.8 All orders placed for delivery anywhere in Australia or New Zealand are shipped via your choice of Australia Post Express Post Satchel (free) or next day Express courier. All other international orders ship by Australia Post International Courier. For some inner Sydney locations we can also deliver the same day providing the order is received prior to 10am. All packages must be signed for by someone (it can be someone other than the addressee) or they will be returned. Current delivery prices are $0 for Australia Post Express Post, $9 ex GST for overnight AU courier, $7 for overnight NZ courier, and $29 international courier for all other locations. If it is necessary to attempt a redelivery of a package because nobody was available to accept the goods, then we reserve the right to charge an additional delivery fee of $12.50. ↑ 3.0 14-Day Satisfaction Guarantee 3.1 Shop online with the comfort of knowing that your order is backed by a 100% Money Back Guarantee. This Guarantee applies if returned within 14 days of shipment and gives you plenty of time to check your order for correctness and compatibility. Any non-faulty returns must be in pristine condition with all original manuals and packaging intact (a broken packaging sticker seal is acceptable). If for any reason you need to return or exchange an item, please contact our Customer Service Department. ↑ 4.0 Returns 4.1 If you are not satisfied with a product for any reason, you may return it for a full refund if returned within 14 days of shipment. Any non-faulty returns must be in pristine condition with all original manuals and packaging intact (a broken packaging sticker seal is acceptable).
Simply contact us. Tell us your name, the order number, which items and how many you are returning, and the reason for the return.
We will reply to the email with an R.A. number and instructions on how to send the items back to us. 4.2 If your goods arrive faulty or damaged, or a fault becomes apparent in the first 14 days after delivery, we will at our discretion either provide a full refund or dispatch new goods as soon as possible after the faulty goods have been returned and confirmed as faulty. ↑ 4.3 Please carefully check specification and compatibility with your requirements prior to purchasing. If the goods are not faulty you have 14 days from the day after the goods arrive to cancel the order and return the goods for a refund. A restocking fee of 25% will apply if the item including packaging is not in as-new condition. A refund will be provided within 7 days. 4.4 If any returned goods are not faulty and the goods contain software that has been opened a 25% restocking fee will apply. ↑ 4.5 Shipping charges are only refundable if we have shipped an item in error or if your product is faulty. ↑ 5.0 GST and Import Duty 5.1 All product prices in our catalogue include GST and are shown in Australian Dollars. When you Check Out, the amount of GST is shown to assist those organisations that budget on an ex-GST basis. For International customers, please note the Ex-GST price, as we do not currently charge GST to you. New Zealand buyers need not be concerned about import duties as all orders are shipped from our Auckland warehouse. All other International customers should consider that import duties and tarrifs may be incurred by purchasing from RamCity. In most countries, orders under the value of AUD$500 are allowed in duty-free, but we cannot be responsible for any duties or charges you may incur. 5.2 GST for Australian orders is charged at the current prevailing rate for Australia (currently 10%). Documentation in the form of a "Tax Invoice" will be emailed to the contact email address supplied at the time of ordering. The Tax Invoice will confirm that GST has been charged and the rate which has been applied. Our Australian Business Number (ABN) - 87 436 655 205 - is clearly shown on all invoices. 5.3 Under Australian taxation rules, GST is applicable to the charges of all couriers and forwarders. 5.4 For New Zealand orders and other countries outside of Australia - no GST is charged by us on your order (but please note section 4.5 following). RamCity reserve the right to change this policy at any time in the future, according to the taxation laws and rules applied by the New Zealand Inland Revenue department and other Government departments overseas. 5.5 All orders for New Zealand buyers are shipped direct from our Auckland warehouse, which means that no additional import duties or GST are applicable on the purchase, as is normally the case for goods imported into New Zealand. All international orders ship from our Sydney warehouse by International Courier. 5.6 For customers departing Australia within 30 days from invoice, the GST component of your purchase may be reimbursed at the point of your departure (eg airport) - check with us for details. ↑ 6.0 Privacy Read our Full Privacy Statement. ↑ 7.0 Security 7.1 The security of your payment information is our top priority at RamCity. 7.2 RamCity guarantees 100% secure ordering for all of our customers. To protect you and your personal account information, Ramcity employs 128-bit SSL (Secure Sockets Layer) technology. SSL is the industry standard and the best software available for secure e-commerce transactions. The SSL technology works by sending all of your personal information, including credit card number, name and address information to our computer in an encrypted code. Only RamCity authorised personell can then decode it. 7.3 RamCity also pledges to use the best and most accepted methods and technologies to insure your personal information is safe and secure. 7.4 If you have any questions about the safety and security of your personal information at RamCity please contact us. ↑ 7.5 If you feel more comfortable placing an order by phone, feel free to phone Australia Toll-free on 1300 883 566, New Zealand local on 9442 7383 or International on +61 2 8212 4133. ↑ 8.0 Pricing and availability 8.1 Whilst we endeavour to ensure the prices on our website are as accurate as possible, we reserve the right to change a price for ordered goods in exceptional circumstances. If a price for an ordered item is corrected due to exceptional circumstances, customers will be informed of the change before payment is processed and offered the opportunity to cancel the order. 8.2 Because of the dynamic nature of technology and markets (e.g. exchange rate variations and other variables beyond our control), prices, versions, product details and availability are subject to change on a continual basis without prior notice. Prices can and do change from day to day; if a price at the time of ordering is higher than a previously-shown price then the price at the time of ordering is the one that applies. 8.3 If an order is placed for an item with an erroneous price, and the erroneous price is less than the cost price of the item, we reserve the right to offer to process the order at cost price or to offer the opportunity for the customer to cancel the order. 8.4 Prices on orders for out-of-stock or pre-release items are valid for one week after the order is placed. If the price changes when stock becomes available customers will be informed of the change before payment is processed, and offered the opportunity to confirm or cancel the order. 8.5 Where stock availability for an item states a quantity "In Stock" then we have stock available in our warehouse, to be allocated to confirmed valid orders in date priority. Occasionally stock may sell out prior to our daily pricing and stock update. On other occasions there may be inventory errors (such as mis-counted or incorrectly located stock in the warehouse) In this case customers will be informed of adverse change in stock availability before payment is processed and offered the opportunity to cancel the order. 8.6 All product prices in our catalogue include GST and are shown in Australian Dollars. All Internatinoal customers please exclude the GST, as we do not currently charge GST to New Zealand, Canada, UK, or US buyers. Also take into account the currency conversion if paying with an overseas credit card, as we always bill in Australian Dollars. If you are looking for a currency converter, try this one. ↑ 9.0 Business Customers 9.1 If you are a business or if the goods are used wholly or in part for business purposes, we shall not be liable to you for any business loss including loss of profits (whether direct or indirect), data, revenue, goodwill, or incidental or consequential loss that you may suffer as a result of the purchase of goods from us. Any other liability shall be limited to the price paid for the goods. We do not exclude our liability for death or personal injury. You will not export any goods purchased from us in contravention of Australian or United States of America export controls. ↑ 10.0 General 10.1 We reserve the right to decline any order for any reason. 10.2 These terms are governed by the laws of Australia and any disputes will be decided only by the courts of Australia. ↑ 11.0. Fraud 11.1 RamCity is committed to reducing the amount of fraud it faces. Our policy is that we will prosecute any cases of fraud that we identify. As a first time customer, you may receive a telephone call or email requesting more information/proof to confirm the details that you have supplied to us. If any of the information you supply is found to be false or misleading, we will, if we deem it appropriate, report this to the appropriate authorities for them to prosecute. ↑ 12.0. Warranty and Guarantee 12.1 All Kingston memory we sell is backed by a lifetime warranty against faults and defects. Warranties for other products vary from 1 year upwards. Please see the specific product page in our catalogue for more information.
12.2 Rest assured that adding memory purchased from RamCity to your system or printer will NOT void your warranty. More details in the RamCity Help Centre.
12.3 All of our memory is guaranteed to work in the computer or device for which you ordered it. If your memory upgrade does not work as expected, please try the following steps to solve the problem before you request an RA (Return Authorisation).
1) Try using our memory alone in your system.
2) Install the largest capacity module first.
3) Make sure the memory is seated in properly.
4) Dust off the memory socket.
5) Update the BIOS to the latest version.
6) Check the RamCity Support Centre for more assistance. 12.4 With the exception of products that are clearly marked as “Ex-Demo”, “Ex-Rental”, soiled, second hand, imperfect or damaged, all products, unless noted otherwise, are sold with a full manufacturer's warranty. The warranty periods and service levels vary by manufacturer and product. Please refer to the specific product's description for information. ↑ 13. Advance Replacement 13.1 If you require an advanced replacement for a defective or incorrectly shipped order, please email the Customer Support Helpdesk: customer-support@ramcity.com.au. 13.2 We will charge your credit card for the advance replacement order and credit it when the defective or incorrectly shipped part is returned. Please mail the product by registered mail to P.O. Box 1817, North Sydney NSW 2060, Australia. We will refund any postage charges incurred for the return of incorrectly shipped parts if you provide a copy of your postage receipt. ↑ 14. Force Majeure 14.1 Neither party shall be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of the party so delaying, and such party shall be entitled to a reasonable extension of time for the performance of such obligations. ↑
